The undoing of democracy as a substantive ideal is most visible in the illegal legalities perpetuated by the Bush-Cheney regime and reproduced under the presidency of Barack Obama that extend from the use of military commissions, the policy of indefinite detention, suppressing evidence of torture, maintaining secret and illegal prisons in Afghanistan to the refusal to prosecute former high-level government officials who sanctioned acts of torture and other violations of human rights.
